2. Independent Travel Agency Disclaimer

Flymark operates as an independent travel intermediation agency. We act solely as an agent in offering, arranging, or booking flight tickets, hotel reservations, car rentals, and other travel-related services provided by third-party suppliers (including, but not limited to, airlines, consolidators, hotel operators, and tour service providers, collectively referred to as “Travel Suppliers”).

  • No Direct Operation: Flymark does not own, manage, operate, control, or provide any aircraft, flights, hotels, or transport services.
  • Supplier Rules: All tickets, travel passes, vouchers, and reservations issued through Flymark are subject to the individual terms, conditions, rules, and tariffs established by the respective Travel Supplier.

3. Booking and Payment Terms

  • Pricing & Availability: All fare quotes, hotel rates, and availability displayed on our Website or provided over the phone are subject to change without prior notice until a booking is fully confirmed and e-tickets or vouchers are officially issued.
  • Payment Authorization: By providing payment details (credit card, debit card, or electronic payment), you authorize Flymark and its authorized payment processors or Travel Suppliers to charge the full total amount for your requested travel reservation, including any applicable agency service fees, taxes, and supplier charges.
  • Price Changes Prior to Issuance: In the event of a fare increase, tax adjustment, or technical error prior to ticket issuance, we reserve the right to inform you of the price difference before finalizing the transaction. You may approve the updated price or cancel the booking without penalty before issuance.
  • Fraud Prevention: To protect against fraudulent credit card activity, Flymark reserves the right to request additional verification documents, such as government-issued photo identification or credit card authorization forms, before issuing tickets.

4. Cancellations, Refunds, and Modifications

  • Supplier Rules Prevail: Cancellations, refunds, flight modifications, name changes, and exchanges are governed by the ticket rules, fare conditions, and policies of the respective Travel Supplier, such as an airline or hotel operator.
  • Non-Refundable Fares: Many flight fares and promotional hotel rates are non-refundable, non-changeable, and non-transferable under the applicable supplier policy.
  • Agency Service Fees: Flymark may charge reasonable administrative or processing fees for handling booking changes, cancellations, or refund requests on your behalf. Agency service fees charged by Flymark are non-refundable, regardless of whether the underlying Travel Supplier approves or denies a refund or modification request, except where applicable law requires otherwise.
  • Schedule Changes & Flight Cancellations: Travel Suppliers may cancel or reschedule flights. Flymark is not responsible for supplier-initiated schedule changes, flight delays, missed connections, or cancellations, but will make reasonable efforts to assist passengers in finding alternatives in accordance with supplier policies.

5. Travel Documentation and Health Requirements

Passengers are responsible for obtaining and verifying all necessary travel documentation before departure, including but not limited to:

  • Passports & Visas: Valid passports, entry visas, transit visas, and re-entry permits. Some destinations may require a passport to remain valid for a specified period beyond the return date.
  • Health & Entry Compliance: Vaccination certificates, health declarations, insurance coverage, and compliance with entry regulations of destination and transit countries.
  • Denied Boarding: Flymark is not liable when a passenger is denied boarding, entry, or transit due to missing or invalid travel documentation or failure to comply with applicable health or entry requirements, to the extent permitted by law.

6. User Conduct and Website Misuse

You agree to use this Website only for legitimate travel inquiries, reservations, and purchases for yourself or people you are legally authorized to represent. You agree not to:

  • Make false, fraudulent, or speculative reservations or bookings in anticipation of demand.
  • Use automated scripts, bots, scrapers, or spiders to access, collect, or index data from our Website without our prior written consent.
  • Impersonate any person or entity, or falsely state or misrepresent your affiliation with a person or entity.
  • Upload or transmit viruses, malicious code, or materials that compromise Website functionality or data security.
  • Interfere with the Website, attempt unauthorized access, or use the services in violation of applicable law.

7. Intellectual Property Rights

All content, trademarks, brand names, text, graphics, logos, images, software, and underlying code on flymark.online are owned by Flyza Travels LLC or its licensors and are protected by applicable intellectual property laws.   • Force Majeure events, including weather conditions, natural disasters, acts of God, strikes, public health emergencies, government restrictions, or wars beyond our reasonable control.

In all events, our total cumulative liability shall not exceed the amount of agency service fees paid directly to traviacar.com for the specific transaction giving rise to the claim.

9. Indemnification

You agree to indemnify and hold harmless Flyza Travels LLC, its affiliates, partners, officers, directors, and employees from and against claims, liabilities, damages, judgments, losses, or expenses (including reasonable attorneys’ fees) resulting from your breach of these Terms, violation of any law or third-party rights, or misuse of this Website, to the extent permitted by applicable law.

10. Governing Law and International Jurisdiction

These Terms and disputes arising out of or relating to your use of our Website or services shall be governed by the laws of the State of Tennessee, United States, without regard to its conflict-of-law principles. Subject to applicable law, you agree to the jurisdiction of the state and federal courts located in Tennessee for the resolution of legal proceedings.

For international customers accessing our services from other countries, mandatory local consumer protection rules and statutory rights shall apply to the extent required by law in the customer’s place of residence.
